Congress Okays Federal Whistleblower Protections

On Tuesday, the Congress finally voted on and approved new legislation ensuring stronger protections for federal whsitleblowers. The legislation is intended to protect federal employees who expose government wrongdoing from retaliation by supervisors. However, the bill missed out on one important point that whistleblower advocates have been asking for a decade ai??i?? it still says nothing about the powers of agencies to nullify whistleblower protections using ai???secrecyai??i?? rules and regulations.

The Whistleblower Protection Enhancement Act or WPEA would be enforced by the Office of Special Counsel. In an official statement welcoming Senateai??i??s approval of the WPEA, the OSC said that the new legislation would allow the OSC to ai???Give whistleblower protections to employees who are not currently covered, including Transportation Security Administration officers.ai??? The law also empowers of OSC to hold entire agencies accountable for retaliatory investigations.

The new WPEA also restores the powers of the Office of Special Counsel to seek disciplinary actions against supervisors who retaliate. The law also has the effect of superseding the impact of previous court decisions that narrowed the scope of protections for government whistleblowers.

Whilstleblower advocates praised the new bill which now awaits the Presidentai??i??s signature to become law. Angela Canterbury, the director or public policy for the Project On Government Oversight said, ai???The WPEA closes many loopholes and upgrades protections for federal workers who blow the whistle on waste, fraud, abuse and illegality.ai???

However, everyone was not happy, and though praising the progress made in protecting government whistleblowers with the new legislation, Tom Devine, the legal director of the Government Accountability Project said that loopholes remained. Devine said ai???It would be dishonest to say our work is done, however, or to deny that government whistleblower rights are second class compared to those in the private sector. According to Devine, two main requirements of a fair legislation still remain blocked: ai???jury trials to enforce newly-enacted protections, and extension of free speech rights to national security workers making disclosures within agency channels.ai???
